Bamboo Encroachment Letter Template
Is your neighbours bamboo now growing in your garden ?
Has bamboo encroached under your boundary fence or is it coming through your hedge ?
If so it would be wise to act before the bamboo takes over more of your garden.
This needs to be raised with your neighbour.
This may not be an easy conversation to have.
The likelihood is that your neighbour will love their bamboo or so they think, until they realise that this bamboo encroachment is now a costly problem.
Very often their first response will be that the bamboo is not a problem, simply brushing the issue under the carpet.
Sadly the bamboo problem is not going to go away on its own, it is just going to get worse.
It is likely that you are going to have to put things in writing.
You will need to detail the issue and any damage that has been caused, including the effect on plants, shrubs and grass.
Explain what you would like done and when.
You will also need to inform them what you will do if they don’t act swiftly, which could include instructing a legal team to handle the issue.
Nuisance Legislation
Bamboo encroachment can be covered under “Nuisance” legislation, this means that the owner of the host plant is responsible for the encroaching bamboo and removal costs.
Receiving news such as this may be a complete surprise, and certainly not a welcome one, but sadly it is unavoidable, unless you are willing to pay for remediation works yourself, which is doubtful.
Bamboo Remediation Costs

You can not force your neighbour to remove their bamboo entirely, although it would be wise for them to do so.
Realistically you can only ask them to remove the bamboo from your garden and to ensure that it does not grow back.
This would mean the excavation of the bamboo from your garden, then the installation of a root barrier to stop any future growth entering.
It should be noted that the root barrier must be installed on the neighbour land, certainly not yours, so not to loose your land.
It is also vital for the neighbour to be able to maintain the root barrier and ensure no bamboo passes it back into your land.
The fact that the root barrier must be installed on the neighbours land will clearly mean that some of the bamboo will need removal to allow space for the root barrier.
With all this considered, the costs, maintenance of root barrier, and the still ever present risk of further encroachment is why we would always believe that complete bamboo removal would be wise.
